Bylaws on contract management, granting of spending power and MRC contracting
Pursuant to applicable laws, the Règlement sur la gestion contractuelle [Bylaw on contract management] adopted by the MRC is available for viewing at any time on this website.
This bylaw, and any other bylaw regarding contract management, in particular any bylaw delegating the power to incur an expense or make a contract on behalf of the MRC, must be permanently published on the MRC’s website (see below for a link to the bylaws).
Contract management informational document
In accordance with the Règlement sur la gestion contractuelle, the MRC must publish the contract management informational document, found in appendix 1 of the bylaw, on its website in order to inform residents and potential contracting parties about measures taken to apply the bylaw.

In accordance with the obligations set forth by the Municipal Code, a list of the contracts made by MRC Brome-Missisquoi that involve an expenditure of $25,000 or more is published on a permanent basis by means of the electronic tendering system approved by the government.

In accordance with section 961.4 of the Municipal Code, the MRC must publish on its website, no later than March 31 each year, the list of all contracts involving an expenditure exceeding $2,000 entered into in the last full fiscal year with the same contracting party if those contracts involve a total expenditure exceeding $25,000.
The list shall indicate, for each contract, the name of the contracting party, the amount of the consideration and the object of the contract.
As per the Municipal Code, the council must, by bylaw, delegate to any public servant or employee the power to establish a selection committee. The council may set the conditions and procedures for exercising the delegation.

In accordance with applicable laws, bylaws on contract management adopted by local municipalities are published on a permanent basis on their own website. However, if a local municipality does not have a website, MRC Brome-Missisquoi must permanently publish the local municipality’s contract management bylaw on its own website.
Local municipalities are still entirely responsible for the content and validity of their contract management bylaws.
All contract management policies adopted by Brome-Missisquoi’s local municipalities under the terms of section 573.3.1.2 of the Cities and Towns Act and section 938.1.2 of the Municipal Code of Québec are deemed to be contract management bylaws adopted under the terms of these same sections as amended by the Act mainly to recognize that municipalities are local governments and to increase their autonomy and powers (SQ 2017, c 13).
Where necessary, publications from local municipalities that do not have a website will be available on this page as provided for by the applicable laws.
